Judge leaves Supreme Court, applies amnesty to Homs


A judge has pardoned former adviser Francesc Homs in the open case for expenses incurred in promoting the operation abroad in a decision that differed from the Supreme Court in saying that current European directives do not prevent the crime of embezzlement from being pardoned.


This is what Toga Carmen García, president of the Investigating Court No. 18 of Barcelona, ​​approved in a memorandum pardoning the former Homs advisor because the expenses he authorized as Secretary General of the Presidency of the Republic between 2011 and 2012 did not involve personal enrichment and did not affect European funds, according to the criteria of the Public Prosecutor’s Office. On the same grounds, the judge also pardoned the other person investigated in the case, the then Minister of Foreign Affairs and the European Union, Senin F.B.

The Court of Auditors has condemned the two government charges for approving between 2011 and 2012 travel and accommodation expenses in Barcelona for those attending a world meeting of Catalan communities abroad (€35,700), for legal advice for an international revitalization project (€14,520) and for grants to the CatDem Foundation (€7,400).

No personal enrichment


The judge considers that the facts are admissible because they are included in the promotion of the operation and because there was no personal enrichment in the embezzlement, since the expenses were intended to cover trips and activities of third parties linked to the promotion of Catalan independence. through Catalan organizations operating internationally. He also rules out that the case will be excluded from the amnesty law due to the impact on EU funds, because in his opinion, neither the instructions already finalized, nor the Court of Auditors’ report show that the diversion of funds harms the EU funds. The financial interests of the community.
